You retain all rights to the images you upload and the watermarked images you download. watermarkpics does not claim any ownership or intellectual property rights over your images.

4. User Responsibilities

You are solely responsible for the images you upload to the Service. By using the Service, you represent and warrant that:

• You own or have the necessary rights, licenses, consents, and permissions to use and authorize the use of any images you upload.
• Your use of the Service and any watermarked images produced will not infringe upon or misappropriate any third party's intellectual property rights or other rights.
• You will not upload images that are illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• You will not upload images that contain viruses, malware, or any other malicious code.

You acknowledge that all image processing occurs locally in your web browser. watermarkpics does not store, transmit, or have access to any images you process through the Service.

5. Limitation of Liability

In no event shall watermarkpics, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall watermarkpics's total aggregate liability to you for all claims arising out of or relating to the use of the Service exceed the amount of one hundred United States dollars ($100.00). This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if watermarkpics has been advised of the possibility of such damage.
